Se rechazó por improcedente la petición planteada por el accionante, toda vez que pretendía que la Corte Constitucional ordenara al Fiscal General de la Nación cumplir una sentencia emanada de la Sala Plena, que es obligatoria desde el momento en que se profiere, sin necesidad de requerimiento ni reconvención alguna.
En virtud de lo anterior, la Corporación argumentó que carece de competencia para resolver la petición dando cumplimiento a lo establecido en el Art. 241 de la Constitución Política.
